BACKGROUND
The application request is a Use Permit to allow a new 9 foot 1-inch tall wooden fence in the front yard of a single-family residence.
Sunnyvale Municipal Code (SMC) Chapter 19.48 requires a Use Permit for front yard fences over 6 feet in height, and for reducible front yard fences over 6 feet in height that are not setback 2 feet from the property line (for every foot over 6 feet). Fence height in the front and reducible front yard are measured from the top of the nearest street curb. The SMC defines a front yard fence to include any fence located between the face of the building and the street. All new fence construction is subject to current SMC permitting requirements.

Previous Actions on the Site: Previous Planning approvals for the site include two tree removal permits (2002-0591 and 2018-7153) that were granted in 2002 and 2018.
ENVIRONMENTAL REVIEW
A Class 3 Categorical Exemption relieves this project from California Environmental Quality Act (CEQA). Class 3 Categorical Exemptions include the construction of new accessory structures including fences (CEQA Section 15303 (e)).
DISCUSSION
