STAFF RECOMMENDATION
Recommendation
- Award a contract in substantially the same form as Attachment 2 to the report in the amount of $293,276.25 to FBD Vanguard Construction, Inc. of Livermore;
- Make a finding of categorical exemption from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section15301(c);
- Authorize the City Manager to execute the contract when all necessary conditions have been met, and
- Approve a 10% contingency in the amount of $29,328.

BASIS FOR RECOMMENDATION
Construction Project No. TR-18-02 was advertised on Demandstar on May 6, 2022. Nine (9) contractors requested bid documents. Sealed bids were opened on June 1, 2022 with three (3) responsive bids received. FBD Vanguard Construction, Inc. submitted the lowest responsive and responsible bid in the amount of $293,276.25 (Attachment 1 - Bid Summary).
ENVIRONMENTAL REVIEW
This project is exempt under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301(c), minor alteration of existing streets and addition of bicycle facilities that do not create additional automobile lanes.
Caltrans has also determined that under the National Environmental Policy Act (NEPA), the project is a Categorical Exclusion under 23 C.F.R. Section 771.117(c)(3) which covers "[c]onstruction of bicycle and pedestrian lanes, paths, and facilities". NEPA review is required for construction projects receiving federal grant funding.
FISCAL IMPACT
Budgeted funds are available in Project 832960 - Lawrence Station Area Sidewalks and Bicycle Facilities. The project budget financial summary is included as Attachment 3 to this report.
