Approval is requested to award a contract in the amount of $644,678 ($446,243 in base services and $198,435 in optional services) to MNS Engineers, Inc. of San Jose for design services for the Sanitary Sewer Main Replacement 2019 Project. Approval is also requested for a 10% contingency in the amount of $64,468.
EXISTING POLICY
Pursuant to Chapter 2.08 of the Sunnyvale Municipal Code, contracts for this type of service are awarded pursuant to a Request for Proposals (RFP) best value process, unless otherwise exempt from the competitive bidding process. Additionally, City Council approval is required for the procurement of goods and/or services exceeding $100,000 in any one transaction.
ENVIRONMENTAL REVIEW
The action being considered does not constitute a “project” within the meaning of the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines section 15378(a) as it has no potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment.
BACKGROUND AND DISCUSSION
Project 825331-Replacement/Repair/Rehabilitation of Sanitary Sewer System provides funding for the design, inspection, and replacement or rehabilitation of sewer lines. The City has over 280 miles of sewer lines, from six inches to forty-eight inches in diameter. Many of these lines are over 50 years old and in deteriorated condition.
The Sanitary Sewer Main Replacement 2019 project will replace or rehabilitate approximately 9,900 lineal feet of sewer mains at the following 16 locations:

• Morningside Drive
• Dona Avenue
• Cumulus Avenue
• Morse Avenue
• El Camino Real
• Plymouth Drive
• Peralta Avenue
• Pala Avenue
• Sunset Avenue
• Carson Drive
• Myrtle Drive
• North Pastoria Avenue
The selected Consultant will be responsible for the design and development of specifications for bidding to perform the necessary replacement or rehabilitation.
A Request for Proposal (RFP) was posted on the City’s public procurement network on June 7, 2019 and distributed to multiple California firms. Five proposals were received on July 12, 2019. Staff from the Departments of Public Works and Environmental Services evaluated these proposals based on their qualifications, experience, programmatic approach, and approach for completing the project.
Following the written evaluation process, Infrastructure Engineering Corporation, Schaafer & Wheeler, and MNS Engineers, Inc. were invited for a scripted presentation and interview. The evaluation team unanimously agreed that MSN Engineers, Inc. was the highly recommended proposer due to their extensive experience with similar projects and experience obtaining Caltrans permits for utility crossing State right of way.
MSN Engineers proposed base pricing in the amount of $446,243. Optional services in the amount of $198,435 are also included for additional evaluation that may be needed for complicated sites, gaining temporary construction easements, performing geotechnical investigations, and for the flexibility to coordinate with permitting agencies, such as Caltrans, which are difficult to estimate.
FISCAL IMPACT
The contract consists of base services in the amount of $446,243, optional services in the amount of $198,435, and a 10% contingency in the amount of $64,468, for a total of $709,146. Funding is available in project 825331-Replacement/Repair/Rehabilitation of Sanitary Sewer System. This project is funded by the Wastewater Management Fund.
PUBLIC CONTACT
Public contact was made by posting the Council agenda on the City's official-notice bulletin board outside City Hall, at the Sunnyvale Senior Center, Community Center and Department of Public Safety; and by making the agenda and report available at the Sunnyvale Public Library, the Office of the City Clerk and on the City's website.
RECOMMENDATION
Recommendation
Take the following actions:
- Award a contract in substantially the same form as Attachment 1 to the report in the amount of $644,678 to MNS Engineers, Inc.
- Authorize the City Manager to execute the contract when all necessary conditions have been met, and
- Approve a 10% contingency in the amount of $64,468
