Approval is requested to award a construction contract in the amount of $152,740 (base bid of $136,740 plus additive alternate of $16,000) to the Guerra Construction Group of Santa Clara for Baylands Park Equipment Replacement - Rebid (Public Works Project No. PR-13/07-14). Approval is also requested for a 15% construction contingency in the amount of $22,911.
ENVIRONMENTAL REVIEW
The California Environmental Quality Act (CEQA) determination for this project is a categorical exemption pursuant to Class 1, Section 15301(a) for existing facilities.
BACKGROUND AND DISCUSSION
This project will replace play equipment and playground surfacing at the Baylands Park Discovery Play Area. The original play equipment was installed in 1993, and to maintain the level of service of the playground and ensure continued and safe usability, the equipment needs to be replaced.
The project was originally bid in August 2014, with a scope encompassing three play locations within Baylands Park - the Discovery, Owl Burrow, and Bay Breeze Play Areas. However, the three bids received were significantly higher than the engineer's estimate, and the bids were rejected by Council on September 30, 2014 (RTC No. 14-0843).
As discussed in RTC No. 14-0843, the rebid was structured for only the Discovery Play Area. The base bid consists of mobilization, demolition, site preparation, and procurement and installation of the new play equipment. An additive alternate was also included for the installation of wood fiber surfacing and certified playground inspection.
This project was bid as follows:
Bid Notice: Advertised in The Sun on November 7, 2014;
Provided to 18 Bay Area Builder's Exchanges;
Posted on Onvia Demandstar public procurement network; and
Published on the City's website.
Bid Response: 12 contractors requested bid documents.
Bid Results: Sealed bids were publicly opened on December 3, 2014;
Five responsive bids were received.
The lowest responsive and responsible bid was from the Guerra Construction Group of Santa Clara in the combined amount of $152,740. The Bid Summary is attached. Because the bid amount is less than budgeted project funds, the additive alternate, at $16,000, is also included.
A 15% construction contingency is requested to handle unforeseen circumstances which may be encountered during construction activities. On this project, the concrete footings of the existing play equipment are not visible, and removal could be more extensive than anticipated. Therefore, a 15% contingency in the amount of $22,911 is requested in lieu of the standard 10%.

Budgeted funds are available in Capital Project 830280 (Sunnyvale Baylands Park Infrastructure), funded by the Park Dedication Fund.
PUBLIC CONTACT
Public contact was made by posting the Council agenda on the City's official-notice bulletin board outside City Hall, at the Sunnyvale Senior Center, Community Center and Department of Public Safety; and by making the agenda and report available at the Sunnyvale Public Library, the Office of the City Clerk and on the City's website.
RECOMMENDATION
Recommendation
1) Make a finding of CEQA categorical exemption pursuant to Class 1, Section 15301(a) for existing facilities; 2) Award a contract, in substantially the same format as Attachment 2 to the report and in the amount of $152,740 (base bid and additive alternate), to Guerra Construction Group for the subject project, and authorize the City Manager to execute the contract when all the necessary conditions have been met; and 3) Approve a 15% construction contingency in the amount of $22,911.
