Award a Contract to HydroScience Engineers, Inc. in the Amount of $1,116,869 for the Mary-Carson Water Plant Upgrade Project (F25-052)

STAFF RECOMMENDATION
Recommendation
Take the following actions:
- Award a Consultant Services Agreement in substantially the same form as Attachment 1 to the report in an amount not to exceed $1,116,869 to HydroScience Engineers, Inc. of San Jose;
- Authorize the City Manager to execute the contract when all necessary conditions have been met; and
- Approve a 10% contingency in the amount of $111,687.

BASIS FOR RECOMMENDATION
An RFP was posted on DemandStar on August 28, 2024, and distributed to multiple California firms for design and construction support services for the Mary-Carson Water Plant Upgrade Project. A sole proposal was received from HydroScience Engineers, Inc. on September 25, 2024. The proposal was reviewed by an evaluation team consisting of Public Works and Environmental Services staff on demonstrated qualifications, experience, understanding, and project approach. An interview was conducted with HydroScience, which was unanimously selected and recommended for award of the contract. HydroScience demonstrated great depth of experience and knowledge with similar projects. A detailed scope of work is included in Attachment 1 to this report.
ENVIRONMENTAL REVIEW
This award is for the design phase and construction support services; therefore, the action being considered does not constitute a “project” within the meaning of the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines section 15378(a) as it has no potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment.
FISCAL IMPACT
Budget is available in Project 825251 - Mary-Carson Water Plant Upgrade. A project budget financial summary is included as Attachment 2 to this report.
PUBLIC CONTACT
Public contact was made by posting the Council meeting agenda on the City's official-notice bulletin board at City Hall, at the Sunnyvale Public Library and in the Department of Public Safety Lobby. In addition, the agenda and this report are available at the NOVA Workforce Services reception desk located on the first floor of City Hall at 456 W. Olive Avenue (during normal business hours), and on the City's website.
Levine Act
LEVINE ACT
The Levine Act (Gov. Code Section 84308) prohibits city officials from participating in certain decisions regarding licenses, permits, and other entitlements for use if the official has received a campaign contribution of more than $500 from a party, participant, or agent of a party or participant in the previous 12 months. The Levine Act is intended to prevent financial influence on decisions that affect specific, identifiable persons or participants.
