STAFF RECOMMENDATION
Recommendation
Take the following actions:
- Award a Consultant Services Agreement in substantially the same form as Attachment 2 to the report in an amount not-to-exceed $2,422,269 to Alta Planning + Design, Inc. of Portland, OR;
- Approve a 10% contingency in the amount of $242,227;
- Authorize the City Manager to execute the contract when all necessary conditions have been met; and
- Find the Project exempt from the California Environmental Quality Act (CEQA) pursuant to Guidelines Section 15262.

BASIS FOR RECOMMENDATION
The East Channel Trail Study will evaluate a multi-use trail along the length of the East Channel within Sunnyvale from Homestead Road to the Bay Trail. The study will evaluate existing conditions, identify design constraints, determine trail alignment options, and evaluate alternatives at the crossings of local roadways, including recommendations for safety improvements for bicycles and pedestrians along the length of the trail. A request for proposals (RFP) was posted on DemandStar on November 8, 2023, and distributed to multiple California firms. One (1) proposal was received on December 14, 2023. Alta Planning + Design, Inc. was the sole proposal for this project. A detailed scope of work is included in Attachment 2 to this report.
ENVIRONMENTAL REVIEW
The action being considered is exempt from the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines section 15262 as the actions relate to the authorization of a feasibility and planning study for possible future actions that the City Council has not approved, adopted or funded. Specifically, consideration of the improvements to bicycle and pedestrian access at Sunnyvale Caltrain Station is not a commitment to any project and thus does not require environmental review at this time. Should Council direct staff to move the project forward, appropriate CEQA analysis will be performed after a final study, which will include concept plans, an implementation plan and cost estimates of any recommended improvements, has been approved.
FISCAL IMPACT
Funding for this project is available in Project 836040 - East Channel Trail Study. A project budget financial summary is included as Attachment 1 to this report.

Public contact was made by posting the Council meeting agenda on the City's official-notice bulletin board at City Hall, at the Sunnyvale Public Library and in the Department of Public Safety Lobby. In addition, the agenda and this report are available at the NOVA Workforce Services reception desk located on the first floor of City Hall at 456 W. Olive Avenue (during normal business hours), and on the City's website.
Levine Act
LEVINE ACT
The Levine Act (Gov. Code Section 84308) prohibits city officials from participating in certain decisions regarding licenses, permits, and other entitlements for use if the official has received a campaign contribution of more than $250 from a party, participant, or agent of a party or participant in the previous 12 months.
