REPORT IN BRIEF

Approval is requested to award a construction contract in the amount of $1,778,642 to Graham Contractors, Inc. of San Jose for Slurry Seal 2025 B SB1 and for approval of a 10% construction contingency in the amount of $177,864.

 

EXISTING POLICY

Pursuant to Chapter 2.09 - construction of the Sunnyvale Municipal Code, City Council approval is required for construction contracts exceeding $250,000.

 

ENVIRONMENTAL REVIEW

This project is exempt under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301(c), for the repair, maintenance, or minor alteration of existing facilities, including highways, streets and similar facilities, involving negligible or no expansion of existing or former use.

 

BACKGROUND AND DISCUSSION

The Slurry Seal 2025 B-SB1 project consists of the installation of 1,339,900 square feet of slurry seal on various street segments along Mathilda Avenue and Wolfe Road (Attachment 3). This project also includes spot asphalt repairs, sewer manhole cover adjustments, and installing thermoplastic pavement striping, markings, legends, green bike lane, and raised pavement markers.

 

This project provides the opportunity to advance some elements of the Active Transportation Plan (ATP). This project will implement striping improvements and bring striping up to current standards on the streets to be slurry sealed. This project includes the following:

                     Enhancing and updating Class IIB buffered bike lanes in the northbound direction of Mathilda Avenue between Iowa and Washington Avenues

                     Enhancing and updating Class IIB buffered bike lanes in the southbound direction of Mathilda Avenue between California Avenue and south of Maude Avenue

                     Adding green dashed pavement color in bicycle-vehicle interaction zones on Mathilda Avenue at the two southbound and two northbound ramps to and from Evelyn Avenue

                     Providing green dashed pavement color in bicycle-vehicle interaction zones at multiple right turn areas on Mathilda Avenue between California and Ahwanee/Almanor Avenues

 

                     Providing green dashed pavement color in bicycle-vehicle interaction zones at multiple right turn areas on Wolfe Road between Evelyn and Fair Oaks Avenues

                     Adding advance stop bars at multiple intersections on Mathilda Avenue and Wolfe Road

                     Providing 6’ minimum width bike lanes and wider in some areas on both Mathilda Avenue and Wolfe Road

 

The Project was advertised on DemandStar on August 23, 2024. Eight (8) contractors requested bid documents. Sealed bids were opened on September 11, 2024, with four (4) responsive bids received. Graham Contractors, Inc. submitted the lowest responsive and responsible bid in the amount of $1,778,642 (Attachment 1, Bid Summary).

 

FISCAL IMPACT

Budgeted funding is available in Project 825290 - Pavement Rehabilitation using SB1 - Road Repair and Accountability Act of 2017 funds. The project budget summary is included as Attachment 4 to this report. Use of this funding source leverages SB1 funding to provide improvements to pavement and markings that benefit bicycles, pedestrians, and improve the City’s pavement condition all in one effort.

 

PUBLIC CONTACT

Public contact was made by posting the Council meeting agenda on the City's official-notice bulletin board at City Hall, at the Sunnyvale Public Library and in the Department of Public Safety Lobby. In addition, the agenda and this report are available at the NOVA Workforce Services reception desk located on the first floor of City Hall at 456 W. Olive Avenue (during normal business hours), and on the City's website.

 

RECOMMENDATION

Recommendation

Take the following action:

-                     Award a contract in substantially the same form as Attachment 2 to the report in the amount of $1,778,642 to Graham Contractors, Inc. of San Jose, CA;

-                     Approve a 10% construction contingency in the amount of $177,864;

-                     Authorize the City Manager to execute the contract when all necessary conditions have been met; and

-                     Make a finding of a categorical exemption from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301(c).

 

Levine Act

LEVINE ACT

The Levine Act (Gov. Code Section 84308) prohibits city officials from participating in certain decisions regarding licenses, permits, and other entitlements for use if the official has received a campaign contribution of more than $250 from a party, participant, or agent of a party or participant in the previous 12 months. The Levine Act is intended to prevent financial influence on decisions that affect specific, identifiable persons or participants.
