STAFF RECOMMENDATION

Recommendation

Take the following actions:

-                     Award a contract in substantially the same form as Attachment 2 to the report in the amount of $665,620 to FBD Vanguard Construction, Inc. of Livermore, CA;

-                     Find that the Project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301(c);

-                     Authorize the City Manager to execute the contract when all necessary conditions have been met; and

-                     Approve a 10% contingency in the amount of $66,562.

 

Report

BASIS FOR RECOMMENDATION

The Pedestrian and Safe Routes to School Improvements in Sunnyvale Neighbors of Arbor Including La Linda (SNAIL) and Braly Corner Neighborhoods Project (TR-23-04) was advertised on PlanetBids on October 31, 2025. Forty-eight (48) prospective bidders requested bid documents. Sealed bids were opened on December 10, 2025, with twelve (12) bids received. FBD Vanguard Construction, Inc. submitted the lowest responsive and responsible bid of $665,620 (Attachment 1 - Bid Summary).

 

The project will implement pedestrian and Safe Routes to School improvements at three (3) intersections: two (2) near Columbia Middle School in the SNAIL neighborhood, and one (1) near Braly Elementary School in the Braly Corners neighborhood. The intersections include Borregas Ave./Hemlock Ave., Borregas Ave./Duane Ave., and Gail Ave./Gladiola Dr. The project will include the installation of enhanced crossing improvements, Rectangular Rapid-Flashing Beacons, high-visibility crosswalks, advance yield markings, curb extensions, streetlight improvements, and green stormwater infrastructure elements.

 

The proposed improvements are located in two Communities of Concern in Sunnyvale as identified by the Metropolitan Transportation Commission (MTC), the metropolitan planning organization for the nine-county San Francisco Bay Area. The project improvements will enhance the crossing experience and safety for students walking to and from the two neighborhood schools. Additionally, the project improvements are aligned with the recommendations of the City's adopted Active Transportation Plan, which addresses the needs of walking and biking. The Active Transportation Plan also focuses on implementing safe routes to school and prioritizing biking and walking safely along students' paths to school.

 

ENVIRONMENTAL REVIEW

This project is exempt under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301(c), minor alteration of existing facilities, mechanical equipment, highways and streets involving negligible or no expansion of use beyond that which presently exists.

 

FISCAL IMPACT

Budgeted funds for Pedestrian and Safe Routes to School Improvements in SNAIL and Braly Corner Neighborhoods are available in Fund 3101 - Capital Projects Fund - General Fund Assets under Project 837090. The project is funded in part by the Community Project Funding / Congressionally Directed Spending (CPF/CDS) program at a maximum reimbursement rate of 88.53%. The City will match the remaining 11.47% using General Funds budgeted under Project 836340 - Transportation and General Fund Grant Matching. The project budget financial summaries are attached as Attachment 3 to this report.

 

PUBLIC CONTACT

Public contact was made by posting the Council meeting agenda on the City's official-notice bulletin board at City Hall, at the Sunnyvale Public Library and in the Department of Public Safety Lobby. In addition, the agenda and this report are available at the City Hall reception desk located on the first floor of City Hall at 456 W. Olive Avenue (during normal business hours), and on the City's website.

 

Levine Act

LEVINE ACT

The Levine Act (Gov. Code Section 84308) prohibits city officials from participating in certain decisions regarding licenses, permits, and other entitlements for use if the official has received a campaign contribution of more than $500 from a party, participant, or agent of a party or participant in the previous 12 months. The Levine Act is intended to prevent financial influence on decisions that affect specific, identifiable persons or participants.
