Staff is recommending Council to award a construction contract in the amount of $292,411 to Golden Bay Construction, Inc. of Hayward for Pedestrian and Bicycle Safety Improvements at the Intersection of Fremont Avenue and Manet Drive/Bobwhite Avenue (Public Works Project No. TR-20-01), approve a 10% construction contingency in the amount of $29,241, and approve Budget Modification No. 2 to fund the project in the amount of $60,000.

 

EXISTING POLICY

Section 1309 of the Sunnyvale City Charter (Charter) requires public works construction contracts be awarded to the lowest responsive and responsible bidder.

 

Pursuant to Section 2.09.040 of the Sunnyvale Municipal Code, City Council approval is required for public works contracts exceeding $250,000 in any one transaction.

 

Pursuant to Section 1305 of the Charter, at any meeting after the adoption of the budget, the City Council may amend or supplement the budget by motion adopted by affirmative votes of at least four members so as to authorize the transfer of unused balances appropriated for one purpose to another, or to appropriate available revenue not included in the budget.

 

ENVIRONMENTAL REVIEW

This project is exempt under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301(c), which applies to repairs, maintenance, or minor alterations of existing facilities (sidewalks, gutters, and similar facilities) involving negligible or no expansion of existing or former use.

 

BACKGROUND AND DISCUSSION

The City received Transportation Development Act (TDA) grant funds in FY 2019/20 and FY 2020/21 in the amounts of $172,712 and $184,876, respectively, for a bicycle and pedestrian improvement project (Project). The funds are identified for use in the design and implementation of Pedestrian and Bicycle Safety Improvements at the intersection of Fremont Avenue and Manet Drive/Bobwhite Avenue. The Project involves installing bi-directional ADA compliant curb ramps, new high visibility crosswalks, new accessible pedestrian push buttons and signal light replacements to improve visibility. Construction is anticipated to start during the summer of 2022.

The City also collected $8,000 in Transportation Impact Fee funds from the developer of the 581 Fremont Avenue project as their fair share contribution to improvements at this intersection, bringing the total amount available for Project 835000 - Pedestrian & Bicycle Safety Improvements at Fremont Ave. & Manet Drive/Bobwhite Ave. to $365,588.

 

The construction project (No. TR-20-01) was advertised on DemandStar on May 6, 2022. Thirty-three (33) contractors requested bid documents and sealed bids were opened on May 25, 2022, with two (2) responsive bids received. Golden Bay Construction, Inc. submitted the lowest responsive and responsible bid in the amount of $292,411.00 (see Attachment 1 - Bid Summary).

 

FISCAL IMPACT

Carryover funds of $308,270 is expected to be available in FY 2022/23 for Capital Project 835000 - Pedestrian & Bicycle Safety Improvements at Fremont Avenue and Manet Drive/Bobwhite Avenue. Project costs consist of the construction contract in the amount of $292,411 and a 10% contingency in the amount of $29,241 for a total of $321,652. Less the design and design contingency budget, funds of $267,240 are available in the Project for construction. Additional funds in the amount of $60,000 are necessary to fully fund construction of the Project. Therefore, a budget modification is necessary to reappropriate $60,000 in Gas Tax funds from Project 825290 - Pavement Rehabilitation to Project 835000 - Pedestrian & Bicycle Safety Improvements at Fremont Avenue and Manet Drive/Bobwhite Avenue. The total project budget for Project 835000 will be $425,288 with the approval of this budget modification. There is no impact to the scope of Project 825290 - Pavement Rehabilitation or reserve impact to the Gas Tax fund.

RECOMMENDATION

Recommendation

Take the following actions:

-                     Make a finding of a categorical exemption from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301(c);

-                     Approve Budget Modification No. 2 in the amount of $60,000;

-                     Award a contract in substantially the same form as Attachment 2 to the report in the amount of $292,411 to Golden Bay Construction, Inc.;

-                     Authorize the City Manager to execute the contract when all necessary conditions have been met; and

-                     Approve a 10% construction contingency in the amount of $29,241
