REPORT IN BRIEF

Approval is requested to award a construction contract in the amount of $647,414 to Earl Adams Tile-Coping + Plastering, Inc., dba Adams Pool Solutions, of Pleasanton for the Columbia Middle School Swimming Pool Infrastructure Project, as well as approval of a 10% construction contingency in the amount of $64,742, and approval of Budget Modification No. 6 in the amount of $180,652.

 

EXISTING POLICY

Pursuant to Chapter 2.09 of the Sunnyvale Municipal Code, City Council approval is required for construction contracts exceeding $250,000.

 

Pursuant to Sunnyvale Charter Section 1305, at any meeting after the adoption of the budget, the City Council may amend or supplement the budget by a motion adopted by affirmative votes of at least four members to authorize the transfer of unused balances appropriated for one purpose or another, or to appropriate available revenue included in the budget.

 

ENVIRONMENTAL REVIEW

This project is exempt under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301(a), which applies to interior or exterior alterations of existing public or private structures, facilities, or mechanical equipment involving such things as interior partitions, plumbing, and electrical conveyances.

 

BACKGROUND AND DISCUSSION

The Columbia Middle School Pool Infrastructure Project (PR-21-09) is part of an effort to modernize and upgrade the existing infrastructure of Sunnyvale’s community pools. It is necessary to provide improvements and upgrades for the Columbia Middle School pool’s mechanical equipment systems to ensure cost-effective operation, extend the pool’s working lifecycle, and continue to provide a safe pool environment for the community to enjoy. The scope of work for this project includes the replacement of existing pool infrastructure, including mechanical equipment, chemical systems, and electrical components. This project will also re-line the surge pit with new concrete.

 

 

 

 

An Invitation for Bids for the Columbia Middle School Pool Infrastructure Project (PR-21-09) was advertised on PlanetBids on July 11, 2025. Fifteen (15) contractors requested bid documents. Sealed bids were opened on August 6, 2025, with four (4) responsive bids received. Adams Pool Solutions submitted the lowest responsive and responsible bid in the amount of $647,414 (Attachment 1 - Bid Summary).

 

FISCAL IMPACT

Funding for construction in the amount of $531,504 is available under Project 825850 - Swim Pools Infrastructure, which is funded by Park Dedication Fee revenue and reimbursements from the Sunnyvale School District. The fee revenue is maintained within Fund 2100-Park Dedication Fund, which has a remaining budget of $32,361. The reimbursements are collected within Fund 3201-Infrastructure Renovation and Replacement Fund with a planned budget of $499,143. The lowest and responsive bid ($647,414) and 10% contingency ($64,742) exceeds the available budget by $180,652.

 

Budget Modification No. 6 has been prepared to appropriate $90,326 in Park Dedication Fund reserves and $90,326 in Infrastructure Renovation and Replacement Fund reserves to project 825850 - Swim Pools Infrastructure.

Per an agreement with the Sunnyvale School District, the District will reimburse 50% of the construction costs. When the reimbursement is received, it will be placed in Fund 3201 - Infrastructure Renovation and Replacement under this project to be appropriated for future pool purposes.

 

PUBLIC CONTACT

Public contact was made by posting the Council meeting agenda on the City's official-notice bulletin board at City Hall, at the Sunnyvale Public Library and in the Department of Public Safety Lobby. In addition, the agenda and this report are available at the City Hall reception desk located on the first floor of City Hall at 456 W. Olive Avenue (during normal business hours), and on the City's website.

 

RECOMMENDATION

Recommendation

Take the following actions:

-                     Award a contract in substantially the same form as Attachment 2 to the report in the amount of $647,414 to Earl Adams Tile-Coping + Plastering, Inc., dba Adams Pool Solutions, of Pleasanton;

-                     Make a finding of categorical exemption from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301(a);

-                     Authorize the City Manager to execute the contract when all necessary conditions have been met;

-                     Approve a 10% contingency in the amount of $64,741.40; and

-                     Approve Budget Modification No. 6 in the amount of $180,652.

 

Levine Act

LEVINE ACT

The Levine Act (Gov. Code Section 84308) prohibits city officials from participating in certain decisions regarding licenses, permits, and other entitlements for use if the official has received a campaign contribution of more than $500 from a party, participant, or agent of a party or participant in the previous 12 months.
