REPORT IN BRIEF
The Planning Commission considered this item on March 9, 2026. The Planning Commission had recommended Approval of Alternatives 1 and 2 (modified Conditions of Approval). The Planning Commission provided feedback regarding the landscaping and added a requirement to limit water discharge and to look into methods for additional vibration monitoring for residents (see Attachment 1 for an excerpt of the final minutes of the Planning Commission meeting of March 9, 2026).

 

This item was scheduled to be reviewed by the City Council on April 7, 2026. However, City staff and the applicant are recommending that this item be continued to a date specific of Tuesday, July 21, 2026. Moving the item to July 21 will allow the applicant and staff additional time to gather information on the questions raised during the Planning Commission meeting, and work on the Recommended Conditions of Approval.

 

PUBLIC CONTACT

This continuance report serves as a notice to the public. Additional notices will be mailed to property owners and residents within the 1,000-foot project noticing radius advising them of the change in schedule. This includes advertisements in the Sunnyvale Sun Newspaper and on-site posting. Notices will also be sent to the Raynor Park and Panama Park Neighborhood Associations and interested parties. Other interested parties will be notified by email.

 

Public contact was also made by posting the Council agenda on the City’s official-notice bulletin board outside City Hall, at the Sunnyvale Senior Center, Community Center and Department of Public Safety; and by making the agenda and report available at the Sunnyvale Public Library, the Office of the City Clerk and on the City’s website.

Recommendation

Continue the City Council public hearing date to July 21, 2026.

 

Levine Act

LEVINE ACT

The Levine Act (Gov. Code Section 84308) prohibits city officials from participating in certain decisions regarding licenses, permits, and other entitlements for use if the official has received a campaign contribution of more than $500 from a party, participant, or agent of a party or participant in the previous 12 months. The Levine Act is intended to prevent financial influence on decisions that affect specific, identifiable persons or participants.
