STAFF RECOMMENDATION

Recommendation

Take the following actions:

-                     Award a contract in substantially the same form as Attachment 2 to the report in the amount of $2,561,259.29 to Casey Construction, Inc of Emerald Hills;

-                     Make a finding of a categorical exemption from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Sections 15301(b),15302(c), and 15303 (d);

-                     Authorize the City Manager to execute the contract when all necessary conditions have been met; and

-                     Approve a 10% contingency in the amount of $256,126.

 

Report

BASIS FOR RECOMMENDATION

The Replacement/Repair/Rehabilitation of Sanitary Sewer System Project (Project No. UY-21-01) consists of the installation of 10,023 linear feet of new sanitary sewer pipe by pipe bursting, open cut, or cured-in-place pipe construction methods at 17 locations within the Cities of Sunnyvale and Cupertino (Attachment 4). Many of the sanitary sewer pipes and manholes designated for replacement with this project were installed in the 1950s. Inspection of these segments show visible signs of aging and deterioration. Most of these pipes are concrete or vitrified clay and will be replaced with current industry standard materials.

 

The Project was advertised on DemandStar on November 22, 2024. Seventy-four (74) contractors requested bid documents. Sealed bids were opened on December 18, 2024, with eleven (11) responsive bids received. Casey Construction, Inc. submitted the lowest responsive and responsible bid in the amount of $2,561,259.29 (Attachment 1, Bid Summary).

 

ENVIRONMENTAL REVIEW

This project is exempt under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Sections 15301(b) for the repair, maintenance, or minor alteration of existing facilities, involving negligible or no expansion of existing or former use; 15302(c) for replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced; and 15303(d) for construction and location of limited numbers of new, small facilities or structures, installation of small new equipment and facilities in small structures, and the conversion of existing small structures from one use to another where only minor modifications are made in the exterior of the structure.

 

FISCAL IMPACT

Budgeted funds are available in Project 825331 - Replacement/Repair/Rehabilitation of Sanitary Sewer System funds. Approximately $539,000 was appropriated in this project in FY 2024/25 and there is sufficient unspent budget form prior years to fund this contract. The project budget summary is included as Attachment 3 to this report.

Public contact was made by posting the Council meeting agenda on the City's official-notice bulletin board at City Hall, at the Sunnyvale Public Library and in the Department of Public Safety Lobby. Levine Act

LEVINE ACT

The Levine Act (Gov. Code Section 84308) prohibits city officials from participating in certain decisions regarding licenses, permits, and other entitlements for use if the official has received a campaign contribution of more than $500 from a party, participant, or agent of a party or participant in the previous 12 months. The Levine Act is intended to prevent financial influence on decisions that affect specific, identifiable persons or participants.
