STAFF RECOMMENDATION

Recommendation

Take the following actions:

-                     Award a Consultant Services Agreement in substantially the same form as Attachment 1 to the report in an amount not-to-exceed $831,398 to BKF Engineers of San Jose;

-                     Approve a 10% contingency in the amount of $83,140;

-                     Authorize the City Manager to execute the contract when all necessary conditions have been met; and

-                     Find the Project exempt from CEQA pursuant to CEQA Guidelines Section 15378 (a).

BASIS FOR RECOMMENDATION

A request for proposals (RFP) was posted on DemandStar on July 18, 2023 and distributed to multiple California firms. Four (4) proposals were received on August 15, 2023. BKF Engineers was selected as the highest-ranked proposer. A detailed scope of work is included in Attachment 1 to this report.

 

ENVIRONMENTAL REVIEW

This award is for design and construction support services; therefore, the action being considered does not constitute a “project” within the meaning of the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines section 15378(a) as it has no potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment.

 

As part of the contract, the consultant will evaluate the project improvements and provide the City with a recommendation on how best to complete CEQA approval for the project improvements. The consultant’s initial review of the project is that it is exempt under Public Resources Code Section 21080.20. The confirmation of applicable CEQA exemptions and the preparation of necessary CEQA clearance documentation are included in the project scope as optional services. The CEQA determination will be brought to City Council for approval prior to starting final design.

 

FISCAL IMPACT

Funding for this project is available in Project 835980 - Evelyn Avenue Multi-Use Trail (Project No. TR-23-02). A project budget financial summary is included as Attachment 2.

 

 

PUBLIC CONTACT

Public contact was made by posting the Council meeting agenda on the City's official-notice bulletin board at City Hall, at the Sunnyvale Public Library and in the Department of Public Safety Lobby. In addition, the agenda and this report are available at the NOVA Workforce Services reception desk located on the first floor of City Hall at 456 W. Olive Avenue (during normal business hours), and on the City's website.
