STAFF RECOMMENDATION
Recommendation
Take the following action:
- Award a contract in substantially the same form as Attachment 2 to the report in the amount of $2,989,550 to Spencon Construction, Inc. of San Ramon, CA;
- Make a finding of categorical exemption from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301(c);
- Authorize the City Manager to execute the contract when all necessary conditions have been met; and
- Approve a 10% contingency in the amount of $298,955.

BASIS FOR RECOMMENDATION
The Concrete Sidewalk, Curb, Gutter, and Driveway Approaches 2023 Project (Project No. ST-23-03) was advertised on Demandstar on September 1, 2023. Eighteen (18) contractors requested bid documents. Sealed bids were opened on September 20, 2023, with five (5) responsive bids received. Spencon Construction, Inc. submitted the lowest responsive and responsible bid in the amount of $2,989,550 (Attachment 1- Bid Summary). A list of locations is included as Attachment 4 to the report.
ENVIRONMENTAL REVIEW
This project is exempt under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301(c), which applies to repairs, maintenance, or minor alteration of existing facilities, mechanical equipment, highways and streets involving negligible or no expansion of use beyond that which presently exists.
FISCAL IMPACT
Budgeted funds are available in Project 829400 - Concrete Sidewalk, Curb, Gutter, and Driveway Approaches 2023. The project budget financial summary is included as Attachment 3 to this report.
