REPORT IN BRIEF
Approval is requested to award a construction contract in the amount of $3,114,784 to Guerra Construction Group of Santa Clara, CA for the Corn Palace Park Development and for approval of a 15% construction contingency in the amount of $467,218.

EXISTING POLICY
Pursuant to Section 2.09.040 of the Sunnyvale Municipal Code (SMC), City Council approval is required for awards of public works contracts exceeding $250,000 and pursuant to Section 2.09.120(c) may waive a minor bid irregularity if the discrepancy does not affect the bid amount or give the bidder an advantage over others.

Section 2.09.120 of the SMC provides that in the consideration of bids for any public works contracts, the awarding authority may waive, if it wishes to do so, minor defects or irregularities in the bids, provided that the discrepancy does not affect the amount or give the bidder an advantage over others.

ENVIRONMENTAL REVIEW
This action is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15303, which exempts construction and location of limited numbers of new, small facilities or structures, and CEQA Guidelines Section 15304, which exempts minor public or private alterations in the condition of land, water, and/or vegetation which do not involve removal of healthy, mature, scenic trees. Furthermore, the traffic and noise impacts of the park were considered within the scope of the Final Environmental Impact Report for the City of Sunnyvale Corn Palace Residential Development Project dated March 1, 2019.
