EXISTING POLICY
Pursuant to Section 2.09.040 of the Sunnyvale Municipal Code, City Council approval is required for awards of public works contracts exceeding $250,000.

ENVIRONMENTAL REVIEW
The proposed project is exempt under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301, which applies to the operation, repairs, maintenance, or minor alterations of existing public and private structures or facilities, involving negligible or no expansion of existing use(s); CEQA Guidelines Section 15302, which applies of replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced; and CEQA Guidelines Section 15304, which exempts minor public or private alterations in the condition of land, water, and/or vegetation which do not involve removal of healthy, mature, scenic trees.

BACKGROUND AND DISCUSSION
The City owns and operates six tennis courts at Sunnyvale Middle School. Based on historical data, usage and current surveys, major reconstruction and repair for each court is required approximately every 30 years. This consists of milling of asphalt, asphalt overlay, court resurfacing, and installation of new tennis court nets, posts, fences, and benches.
