Approval is requested to award a Service Agreement in substantially the same form as Attachment 1 to this report to Brodart Co. in an amount not-to-exceed $420,000 for the Opening Day Collection (ODC) at Lakewood Branch Library and Learning Center. Approval is also requested to delegate authority to the City Manager to renew the contract for up to five additional one-year periods and increase the contract amount subject to budget availability for ongoing collection development services.

EXISTING POLICY
Pursuant to Chapter 2.08 of the Sunnyvale Municipal Code, contracts for this type of service are awarded pursuant to a Request for Proposals (RFP) best value process, unless otherwise exempt from the competitive bidding process. Additionally, City Council approval is required for the procurement of goods and/or services exceeding $250,000 in any one transaction.

ENVIRONMENTAL REVIEW
The action being considered does not constitute a "project" within the meaning of the California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines section 15378(a) as it has no potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment.

BACKGROUND AND DISCUSSION
Materials are required for the Opening Day Collection (ODC) for the new Lakewood Branch Library and Learning Center, which is currently under construction with an estimated completion date of late 2025. Materials should be appropriate for a public library collection consisting of mostly popular titles in a variety of formats, including graphic novels, board books, and paperbacks.
