Recommendation
Ratify the Contract in Attachment 1 to the report with Bear Electrical Solutions to accept and approve the corrected services agreement with the City of Sunnyvale.

BASIS FOR RECOMMENDATION
On June 17, 2025, the Council awarded a three-year contract to Bear Electrical Solutions, LLC for traffic signal preventative maintenance and repair services in the amount of $4,214,752.44 (RTC No. #25-0603). A draft services agreement related to another project was erroneously attached to the staff report. The Council took an action to approve the contract to Bear Electrical for the bid price of not-to-exceed $4,214,752.4. Therefore, the contract was lawfully awarded to Bear Electrical as required by Sunnyvale Municipal Code Sections 2.08.040(d) and 2.08.160. The City Manager signed the contract to hold the price, which expired June 30, 2025. Staff recommends that the Council confirm the action by ratifying the contract with Bear Electrical Solutions for Traffic Signal Preventative Maintenance and Repair Services, as provided in Attachment 1 to this report.
ENVIRONMENTAL REVIEW
The action being considered does not constitute a "project" within the meaning of the California Environmental Quality Act ("CEQA") under CEQA Guidelines section 15378(a) as it has no potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment.
FISCAL IMPACT
Funding for this contract is available in the operating budget in the General Fund under Program 13100 - Transportation and Traffic Services and Program 13300 - Street Lights, Signs and Debris.
