Approval is requested to award a construction contract in the amount of $988,001 to K.J. Woods Construction, Inc. of San Francisco for Waterline Replacement 2012-2013 Phase 3 (Public Works Project No. UW-13/03-13). Approval is also requested for a 10% construction contingency in the amount of $98,800.
 
ENVIRONMENTAL REVIEW
The California Environmental Quality Act (CEQA) determination for this project is a categorical exemption pursuant to Class 2, Section 15302(c) for the rehabilitation of existing facilities.
 
BACKGROUND AND DISCUSSION
The City's water utility is aging and has many infrastructure renovation needs, both in the short-term and over a longer period. Capital Project 825451 (City-wide Water Line Replacement) provides for the ongoing replacement of aged and damaged water lines. The project also provides standardization on piping materials (PVC C-900 pipe), replaces valves and fire hydrants, and upgrades fittings for seismic stability.
 
Waterline Replacement 2012-2013 Phase 3, along with Phases 1 and 2, consolidate several years of annual waterline replacement projects in order to ensure the expenditure of Bond Proceeds received in 2010. Construction of the Phase 1 and Phase 2 projects were completed in 2013.
 
The scope of work for this project includes the replacement of approximately 5,000 linear feet of existing water lines, 122 water service lines, gate valves, meters, meter boxes and fire hydrants at the following locations:  Fernwood Circle, Carroll Street between Old San Francisco and Iowa, Jarvis Court, Jackson Avenue and 1261-1271 Oakmead Parkway.
 
This project was bid as follows:
 
Bid Notice:          Advertised in The Sun on May 4, 2014;
                          Provided to 18 Bay Area Builder's Exchanges;
                          Posted on Onvia Demandstar public procurement network; and
                          Published on the City's website.
 
Bid Response:    20 contractors requested bid documents.
Bid Results:         Sealed bids were publicly opened on May 28, 2014;
                           Five responsive bids were received.
 
The lowest responsive and responsible bid was from K.J. Woods Construction, Inc. in the amount of $988,001. The bid amount is approximately 12.4 % below the engineer's estimate of $1,128,000. The Bid Summary is attached. Staff recommends accepting the bid from K.J. Woods Construction, Inc., the lowest responsive and responsible bidder. Staff also recommends the award of a 10% construction contingency on this project.
 
It should be noted that a sixth bid in the amount of $1,531,682 was received from Stoloski & Gonzalez, Inc. of Half Moon Bay, but it was determined to be nonresponsive because the contractor did not bid the correct quantities for the project.

Budgeted funds are available in Capital Project 825451 (City-wide Waterline Replacement), funded by the Water Supply and Distribution Fund.
 
PUBLIC CONTACT
Public contact was made by posting the Council agenda on the City's official-notice bulletin board outside City Hall, at the Sunnyvale Senior Center, Community Center and Department of Public Safety; and by making the agenda and report available at the Sunnyvale Public Library, the Office of the City Clerk and on the City's website.
 
RECOMMENDATION
Recommendation
1) Award a contract, in substantially the same format as Attachment 2 and in the amount of $988,001, to K.J. Woods Construction, Inc., for the subject project, and authorize the City Manager to execute the contract when all the necessary conditions have been met; 2) Approve a 10% construction contingency in the amount of $98,800; and 3) Make a finding of CEQA Categorical Exemption for the project.
