Approval is requested to award a construction contract in the amount of $3,097,160 to Granite Rock Company of San Jose for Fremont Avenue Pavement Rehabilitation 2014 (Public Works Project No. ST-13/05-14). Approval is also requested for a 10% construction contingency in the amount of $309,716.
 
ENVIRONMENTAL REVIEW
The California Environmental Quality Act (CEQA) determination for this project is a  categorical exemption pursuant to Class 1, Section 15301.
 
BACKGROUND AND DISCUSSION
Capital Project 825290 (Pavement Rehabilitation) provides for ongoing roadway infrastructure rehabilitation, with the goal of accelerating street repairs to return the average Pavement Condition Index (PCI) of City streets to a level of 80+. Each year the Public Works Pavement Operations staff surveys one half of the City's streets and inputs the data in the City's pavement management system. The system produces a list of deteriorated streets and plans are made to repair, slurry seal, double chip seal, overlay, or reconstruct the streets as needed.  Fremont Avenue was identified by the system as a priority for rehabilitation.
 
The work scope for this project will include pavement preparation, asphalt grinding, and dig outs, followed by asphalt rubberized hot mix overlay on the street. Also included is minor concrete work, crack sealing, striping and adjusting utility boxes to grade. The location of work includes Fremont Avenue between Belleville Way and Hollenbeck Avenue and also from Sunnyvale-Saratoga Road to Wolfe Road.
 
This project was bid as follows:
 
Bid Notice:          Advertised in The Sun on May 2, 2014:
                          Provided to 18 Bay Area Builder's Exchanges;
                          Posted on Onvia Demandstar public procurement network; and
                          Published on the City's website.
 
Bid Response:   19 contractors requested bid documents.
 
Bid Results:       Sealed bids were publicly opened on May 21, 2014;
                         Four responsive bids were received.
 
The lowest responsive and responsible bid was from Granite Rock Company in the amount of $3,097,160. The bid is approximately 16.4 % below the engineer's estimate of $3,705,000. The Bid Summary is attached. A fifth bid in the amount of $3,487,969 was received from O'Grady Paving, Inc. of Mountain View, but it was determined to be nonresponsive because the contractor did not bid the correct quantities for the project. Staff recommends accepting the bid from Granite Rock Company, the lowest responsive and responsible bidder. Staff also recommends the award of a 10% construction contingency on this project.

Budgeted funds are available in Capital Project 825290 (Pavement Rehabilitation), funded by the General Fund, the SB83 VRF Road Improvement Fund, and the Gas Tax Fund. This project does not affect the operating budget.

Public contact was made by posting the Council agenda on the City's official-notice bulletin board outside City Hall, at the Sunnyvale Senior Center, Community Center and Department of Public Safety; and by making the agenda and report available at the Sunnyvale Public Library, the Office of the City Clerk and on the City's website.
 
RECOMMENDATION
Recommendation
1) Award a contract, in substantially the same format as Attachment 2 and in the amount of $3,097,160, to Granite Rock Company for the subject project and authorize the City Manager to execute the contract when all the necessary conditions have been met, 2) Approve a 10% construction contingency in the amount of $309,716, and 3) Make a finding of CEQA Categorical Exemption for the project.
