Authorize the City Manager to Execute Two Funding Agreements between the City of Sunnyvale and Santa Clara Valley Transportation Authority for State Route 237 Express Lanes Project Phase II

Report
BACKGROUND
In 2013, the City approved two development projects that were required, as part of their conditions of approval, to provide fair share contributions for the design and construction of the State Route 237 Express Lane Project Phase II (237 Project).
The Moffett Gateway project, located at 1221 Crossman Avenue, was approved by the Planning Commission on August 26, 2013. Condition of approval BP-11b requires the development to provide a fair share contribution to the 237 Project in the amount of $1,162,042. The Moffett Place Project, located at 1152 Bordeaux Avenue, was approved by City Council December 3, 2013. Condition of approval BP-13b requires the development to provide a fair share contribution to the 237 Project in the amount of $577,062. Both developments have provided their fair share contributions to the City.
EXISTING POLICY
Policy LT -1.8 - Support statewide, regional and sub-regional efforts that provide for an effective transportation system.

LT-1.8a - Endorse funding to provide transportation system improvements that facilitate regional and interregional travel.

LT-1.8c - Advocate improvements to state and county roadways serving Sunnyvale.

LT-1.8d - Support efforts to plan and implement effective inter-jurisdictional transportation facilities.

ENVIRONMENTAL REVIEW
The agreements do not require environmental clearance. The Valley Transportation Authority (VTA) and Caltrans will complete a Categorical Exemption for construction of the project.

DISCUSSION
The design and construction of the 237 Project is managed by the VTA. The project is funded by multiple funds including Federal, State, Local and City. Per the proposed Agreements (Attachment 1 and 2), the VTA will use the fair shar...
