Approval is requested to award a construction contract in the amount of $1,545,100 to Anderson Pacific Engineering Construction, Inc., of Santa Clara for the Emergency Flow Management Improvements project (Public Works Project No. UY-14/01-15). Approval is also requested for a 10% construction contingency in the amount of $154,510.
EXISTING POLICY
Section 1309 of the City Charter requires construction contracts to be awarded to the lowest responsive and responsible bidder.
ENVIRONMENTAL REVIEW
The CEQA determination for this project is a Categorical Exemption pursuant to Class 1, Section 15301. Class 1 exemptions include repair, maintenance and minor alterations of existing public facilities involving negligible or no expansion of use.
BACKGROUND AND DISCUSSION
As the Sunnyvale Clean Water Program moves forward to reconstruct the Water Pollution Control Plant (WPCP), other projects are still required to keep the facilities functioning. The Emergency Flow Management project will construct two significant improvements that are related to the power generation facility and absence of a reliable backup power source.
The WPCP has a power generation facility (PGF) that utilizes landfill gas, digester gas and air blended natural gas. This PGF utilizes engines that run on these blended gasses to generate power which is utilized by various processes at the WPCP. Due to the changes in gas quality, the variable heating values associated with the blended gas and inability to regulate it, the operation has become less stable creating a challenge to meet emissions regulatory compliance. This project will modify how and where the gas is mixed as well as install new controls and a gas analyzer so the blended gas can be continuously monitored and controlled to create a stable blended gas. This in turn will allow the engines to run more efficiently thereby creating less emissions, making it easier to meet regulatory compliance.
The WPCP also experiences area specific power outages as well as plant-wide power outages that create challenging situations due to the absence of a centralized reliable power distribution and backup system. Each time power is lost not only is a great deal of time and money spent bringing various processes back on line but the City runs the risk of violating regulatory compliance limits related to plant discharge. Currently there is no reliable source of backup power and in the past during several of these types of emergencies the WPCP has had to rent portable generators at a premium cost to keep operations running. The Emergency Flow Management project will install a portable standby generator that will be used to power selected motor control centers to address power failures within the plant distribution system. The portable generator is trailer mounted and will be able to be positioned at several locations around the facility to provide backup power to specific processes when needed. Although it has the ability to be connected to all loads powered through the distribution system, due to size constraints it will not be capable of powering all loads simultaneously.
The Invitation for Bids (IFB) for this project was advertised in the Sunnyvale Sun on October 23, 2015, distributed to eighteen Bay Area Builder’s Exchanges and published on the City’s website through the Demandstar public procurement network. Four contractors requested bid documents. Sealed bids were opened on November 11, 2015, with two responsive bids received.
The lowest responsive and responsible bid was submitted by Anderson Pacific Engineering Construction Inc., in the amount of $1,545,100. The Bid Summary is attached.
FISCAL IMPACT
Budgeted funds are available in Capital Project 827020, Emergency Flow Management Infrastructure.
Funding Source
This project is funded by the Wastewater Management Fund.

Public contact was made by posting the Council agenda on the City's official-notice bulletin board outside City Hall, at the Sunnyvale Senior Center, Community Center and Department of Public Safety; and by making the agenda and report available at the Sunnyvale Public Library, the Office of the City Clerk and on the City's website.

Recommendation
1) Make a finding of CEQA Categorical Exemption pursuant to Class 1, Section 15301 for maintenance and minor alterations of existing public facilities involving negligible or no expansion of use; 2) award a contract, in substantially the same format as Attachment 2 to the report and in the amount of $1,545,100 to Anderson Pacific Engineering Construction, Inc.; and 3) approve a 10% construction contingency in the amount of $154,510.
