BACKGROUND

On December 15, 2015, the Sunnyvale City Council unanimously approved the actions required to form and participate in the Silicon Valley Clean Energy Authority (SVCEA).  The Authority, once established, will operate a Community Choice Energy (CCE) program to pool the electricity demand within participating jurisdictions to directly procure or generate electrical power supplies on behalf of their residents and businesses. 

 

There are 12 communities in Santa Clara County proposed to consider participation in SVCEA.  Each community is required to complete its decision making by March 31, 2016.  Among the required decisions is the appointment of a regular and an alternate Director to the SVCEA Board of Directors.

 

EXISTING POLICY

Policy 7.4.12 Council Appointments to Intergovernmental Agencies

The City Council appoints members to a variety of intergovernmental agencies in order to represent the City’s interests and to influence policies and regulations of other agencies.

 

ENVIRONMENTAL REVIEW

The action being considered does not constitute a “project” with the meaning of the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines section 15378(b)(5) in that it is a governmental organizational or administrative activity that will not result in direct or indirect changes in the environment.

 

DISCUSSION

The Joint Powers Agreement (JPA) establishing SVCEA stipulates that the governing body of each party shall appoint one regular Director and one alternate Director to serve on the Board of Directors.  The person appointed as the regular Director must be a member of the governing body (City Council).  The person appointed as the alternate Director may be a member of the governing body, staff, or the public.

 

There is no term limit specified in the JPA. In accordance with City policy, appointments to the Board would be approved by the Council on an annual basis in January. If at any time a vacancy occurs, a replacement must be appointed within 90 days.

 

FISCAL IMPACT

The December 15, 2015, staff report detailed costs associated with the Authority’s formation.  No additional costs are associated with the adoption of the ordinance or appointment of a regular and alternate Director to the Authority.

 

PUBLIC CONTACT

Public contact was made by posting the Council agenda on the City's official-notice bulletin board outside City Hall, at the Sunnyvale Senior Center, Community Center and Department of Public Safety; and by making the agenda and report available at the Sunnyvale Public Library, the Office of the City Clerk and on the City's website.
