BACKGROUND AND DISCUSSION
The Political Reform Act requires every local government agency to review its Conflict of Interest Code biennially to determine if the Code is accurate, or alternatively, that the Code must be amended. The City’s Conflict of Interest Code was last reviewed in 2014 and amended November 11, 2014 by Resolution No. 673-14 (see Attachment 1).
In order to ensure that conflict of interest codes remain current and accurate, the City Council as a code-reviewing body approves the issuance of a Biennial Notice (see Attachment 2) to any agency within its jurisdiction to review their conflict of interest codes. The Political Reform Act requires that no later than October 1 of each even-numbered year, each agency must submit to its code-reviewing body a notice indicating whether or not an amendment is necessary.
The City Council serves as the code-reviewing body for the Successor Agency for the Former Redevelopment Agency of the City of Sunnyvale (Successor Agency) and the Oversight Board for the Successor Agency.
If amendments to an agency’s code are necessary, the amended code, including changes to designated positions and/or disclosure categories, must be forwarded to the City Council within 90 days of the City Council receiving the agency’s Local Agency Biennial Notice for review and approval.
Regarding the City’s Conflict of Interest Code, it has been determined that amendments are necessary and the City Clerk will return to Council within 90 days with a proposed resolution to amend the City’s Conflict of Interest Code.
ENVIRONMENTAL REVIEW
The action being considered does not constitute a “project” within the meaning of the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines section 15378(b)(5) in that it is a governmental, organizational or administrative activity that will not result in direct or indirect changes in the environment.
FISCAL IMPACT
None.
PUBLIC CONTACT
Public contact was made by posting the Council agenda on the City's official-notice bulletin board outside City Hall, at the Sunnyvale Senior Center, Community Center and Department of Public Safety; and by making the agenda and report available at the Sunnyvale Public Library, the Office of the City Clerk and on the City's website.
RECOMMENDATION
Recommendation
Review and approve the issuance of the Biennial Notice and direct the City Clerk to return to Council within 90 days with a proposed resolution to amend the City’s Conflict of Interest Code.
