DISCUSSION
A Special Municipal Election was held August 16, 2016 for the purpose of electing a Councilmember to fill the unexpired term in vacant Councilmember Seat Number 4. The Santa Clara County Registrar of Voters has canvassed the returns of the election and on August 29, 2016, the City Clerk received the Registrar of Voters' Certification of Election Results.

California Elections Code Section 10263 requires the City Council to adopt a resolution reciting the fact of the election and to declare elected the person receiving the highest votes cast for the office. The term will commence at the regular meeting during which the Certification of Election Results is approved by resolution of the Council, and will expire at the first meeting in January 2017 following the Certification of the Election Results of the November 8, 2016 General Municipal Election.

The attached resolution recites the number of votes cast and percentage of the vote received by each candidate, and declares the following person elected to the office of Councilmember Seat Number 4: Larry Klein
