BACKGROUND
The Moffett Towers II project, located at 1111 Lockheed Martin Way, was approved by the Planning Commission on May 23, 2016 (RTC No. 16-0132). Condition of approval BP-10a (Attachment 1) required the developer to provide a fair share contribution of $380,000 to mitigate project impacts on the freeway system, specifically on the 237 corridor per the Environmental Impact Report. The payment was made to the City on September 9, 2016.
EXISTING POLICY
General Plan Chapter 3 Land Use and Transportation Goal C:
POLICY 30: Maintain a funding mechanism where new and existing land uses equitably participate in transportation system improvements.
POLICY 46: Support statewide, regional, and subregional efforts that provide for a safe, effective transportation system that serves all travel modes consistent with established service standards.
POLICY 48: Support regional and cross-regional transportation improvements and corridors while minimizing impacts to community form and intracity travel.
ENVIRONMENTAL REVIEW
On April 19, 2016, the City Council certified a Subsequent Environmental Impact (SEIR) Report to the program level Environmental Impact Report for the Moffett Park Specific Plan. Conditional of Approval BP-10a requiring the developer to make a fair share contribution to this project was analyzed by the SEIR. As the proposed action was analyzed by the SEIR and does not involve any new significant effects beyond those analyzed in the SEIR and no further environmental review is required to take this action. The Santa Clara Valley Transportation Authority (VTA) and Caltrans will complete a Categorical Exemption for Construction of the project.
DISCUSSION
The design and construction of the State Route 237 Project is managed by the VTA. The project is funded by multiple funding sources including Federal, State, Local and City. Per the proposed Agreement (Attachment 2), the VTA will use the fair share funds for work required to complete the State Route 237 Project, including the following:
• Serve as project manager
• Coordinate with the State of California for project review and approval
• Advertise, award and administer the construction contract
• Conduct construction activities
• Close-out the project
The Project is currently under final design, right-of-way and electronic tolling system development phase. These activities are expected to be completed by late summer 2017. Construction is expected to start late 2017 for a construction period of two years. City staff will continue to participate throughout the process including monthly meetings with VTA, and the VTA will provide updates on their website for public review.
FISCAL IMPACT
No fiscal impact to the City. The agreement only includes developer funds that can only be used for the State Route 237 Project. Funds were received and deposited. Upon approval of this funding agreement, the funds will be transferred to the VTA.
PUBLIC CONTACT
Public contact was made by posting the Council agenda on the City's official-notice bulletin board outside City Hall, at the Sunnyvale Senior Center, Community Center and Department of Public Safety; and by making the agenda and report available at the Sunnyvale Public Library, the Office of the City Clerk and on the City's website.

Recommendation
Authorize the City Manager to execute the funding agreement for an amount not to exceed $380,000 between the City of Sunnyvale and Santa Clara Valley Transportation Authority for the State Route 237 Express Lanes Project Phase 2.
