On November 27, 2017, Planning Commission approved Special Development Permit (#2017-7633) to allow the construction of a 18,600 sq. ft. commercial building for a child care center use. The Planning Commission approved the project with modified conditions, including a condition for pervious materials to be used for parking lots and walkways, as captured in the minutes:

Modify BP-10 to specify the use of pervious materials for the parking lot and walkways.

The applicant has requested that the condition be modified to require pervious materials "where feasible." Staff considers this a minor change and therefore, staff will require the applicant to submit an application for a Miscellaneous Plan Permit to modify the condition. The MPP can be approved at a staff level by the Director of Community Development.

If the modification were to be considered a "major" change, the Planning Commission approval would be required. However, staff feels that the change is minor in nature because the Planning Commission typically adds "if feasible" when it imposes conditions for pervious pavers. For comparison, the residential project at 1023 N. Fair Oaks Avenue (2017-7453) considered by the Planning Commission the same night included the following condition of approval:

Add BP-9 h) to specify the use of pervious materials for the driveway and walkways, where feasible.
