REPORT IN BRIEF
Approval is requested to award a construction contract in the amount of $961,012 to JJR Construction, Inc. of San Mateo for the Fair Oaks Avenue Bikeway and Streetscape project (Public Works Project No. TR-17-06) and for a 10% construction contingency in the amount of $96,101. Approval is also requested for Budget Modification No. 15 in the amount of $131,666 to fully fund the project.
EXISTING POLICY
Section 1309 of the City Charter requires construction contracts to be awarded to the lowest responsive and responsible bidder. Pursuant to Section 2.09.040 of the Sunnyvale Municipal Code, City Council approval is required for public works contracts exceeding $100,000 in any one transaction. Further, pursuant to Section 2.09.120 (c) City Council may waive a minor bid irregularity if the discrepancy does not affect the bid amount or give the bidder an advantage over others.
Pursuant to Sunnyvale Charter Section 1305, at any meeting after the adoption of the budget, the City Council may amend or supplement the budget by a motion adopted by affirmative votes of at least four members so as to authorize the transfer of unused balances appropriated for one purpose to another, or to appropriate available revenue not included in the budget.
ENVIRONMENTAL REVIEW
The proposed project is categorically exempt from environmental review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301 (c) as it involves the maintenance or repair of an existing street, involving negligible or no expansion of use beyond which presently exists.
