Approval is requested to award a contract to HDR Engineering, Inc. of Folsom, in an amount not-to-exceed $282,231.61 for Consultant Assistance for Phase II of the Sunnyvale Materials Recovery and Transfer Station (SMaRT Station(r)) NextGen Project.

EXISTING POLICY
GOAL EM-15 - ENVIRONMENTALLY -SOUND DISPOSAL: Dispose of solid waste in an environmentally sound, dependable and cost -effective manner. (Previously Solid Waste Goal 3.2D / Adopted in 1996)

Pursuant to Section 2.08.040 of the Sunnyvale Municipal Code (SMC), City Council approval is required for the procurement of goods and/or services exceeding $100,000 in any one transaction.

Further, SMC Section 2.08.070(b)(3) authorizes the purchase of goods and/or services to be exempted from the competitive bidding requirements when the solicitations of bids or proposals would be impractical, unavailing or impossible.

ENVIRONMENTAL REVIEW
The action being considered does not constitute a "project" within the meaning of the California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines Section 15378(a) as it has no potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment.

Furthermore, this action is exempt from environmental review pursuant to Section 15262 of the CEQA Guidelines (feasibility and planning studies for possible future actions that have not been approved, adopted or funded). The City Council certified an Environmental Impact Report (EIR) for the SMaRT Station in 1990 (SCH #89022812).
