REPORT IN BRIEF
Staff is recommending Council award a contract to Redgwick Construction Co. for pedestrian and bicycle improvements on Homestead Road at Homestead High School. Staff is also recommending approval of Budget Modification No. 25 to fund the project in the amount of $128,353.
EXISTING POLICY
Pursuant to Chapter 2.09 of the Sunnyvale Municipal Code, City Council approval is required for construction contracts exceeding $250,000.
Pursuant to Sunnyvale Charter Section 1305, at any meeting after the adoption of the budget, the City Council may amend or supplement the budget by a motion adopted by affirmative votes of at least four members to authorize the transfer of unused balances appropriated for one purpose or another, or to appropriate available revenue included in the budget.
ENVIRONMENTAL REVIEW
The California Environmental Quality Act (CEQA) determination for this project is a categorical exemption pursuant to CEQA Guidelines Section 15301(c) for operation, repair or minor alteration of existing streets, sidewalks and pedestrian trails.
BACKGROUND AND DISCUSSION
This project will modify the traffic signals at the Homestead Road/Mary Avenue and Homestead Road/Kennewick Drive intersections and provide pedestrian access enhancements such as installation of high visibility crosswalks, accessible pedestrian signals, and shortening crossing for pedestrians where possible. The project also includes installation of green buffered bike lanes on the south side along Homestead Road between MacKenzie Drive and Mary Avenue, and on the north side along Homestead Road between Mary Avenue and Kennewick Dr. Project design is complete. Construction is expected to start in summer 2021 when the Homestead High School is closed.
The construction project (Project No. TR-18-06) was advertised on Demandstar on February 12, 2021. Twenty (20) contractors requested bid documents and sealed bids were opened on March 10, 2021, with three (3) responsive bids received. Redgwick Construction Co. submitted the lowest responsive and responsible bid in the amount of $1,091,866 (see Attachment 1 - Bid Summary).
FISCAL IMPACT
Costs for the contract and contingency total $1,201,053. Budgeted funds of $1,072,700 are available for the construction contract in capital project 833800 - Homestead Road at Homestead High School Pedestrian and Bicycle Improvements. Additional funds of $51,336 from project 825290 - Pavement Rehabilitation (for the pavement portion of the project), and $77,017 of Transportation Impact Fee funding are being requested to fully fund construction.

RECOMMENDATION
Recommendation
Take the following actions:
- Make a finding of categorical exemption from the California Environmental Act (CEQA) pursuant to CEQA Guidelines Section 15301(c);
- Award a contract in substantially the same form as Attachment 2 to the report in the amount of $1,091,866 to Redgwick Construction Co.;
- Approve a 10% construction contingency in the amount of $109,187; and
- Approve Budget Modification No. 25 in the amount of $128,353.
