STAFF RECOMMENDATION
Recommendation
- Award a Consultant Services Agreement in substantially the same form as Attachment 1 to the report in an amount not-to-exceed $3,428,221 to Mark Thomas & Company, Inc. of San Jose;
- Approve a 10% a contingency in the amount of $342,822; and
- Authorize the City Manager to execute the contract when all necessary conditions have been met.

BASIS FOR RECOMMENDATION
Staff posted a Request for Proposals (RFP) on DemandStar on October 28, 2021 and distributed it to multiple California firms. The City received three (3) proposals December 14, 2021. Staff selected Mark Thomas, Inc. as the highest-ranked proposer. A detailed scope of work is included in Attachment 1.
ENVIRONMENTAL REVIEW
The design stage of the Project will include the required environmental review pursuant to the California Environmental Quality Act (CEQA). The appropriate CEQA document will be prepared based on the results of an Initial Study and presented to City Council at the appropriate time prior to final approval of the Project.
FISCAL IMPACT
Funding for this project is available under Project 835630 - Stevens Creek Trail Extension (Project No. TR-22-01). A project budget financial summary is included as Attachment 2 to the report.
PUBLIC CONTACT
Public contact was made by posting the Council agenda on the City's official-notice bulletin board outside City Hall, at the Sunnyvale Public Library, Senior Center, Community Center and in the Department of Public Safety Lobby. In addition, the agenda and report are available at the Sunnyvale Public Library, Office of the City Clerk, and on the City's website.
