STAFF RECOMMENDATION
Recommendation
- Award a contract in substantially the same form as Attachment 2 to the report in the amount of $1,038,000 to Bear Electrical Solutions, Inc. of Alviso, CA;
- Make a finding of categorical exemption from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301(c);
- Authorize the City Manager to execute the contract when all necessary conditions have been met; and
- Approve a 5% contingency in the amount of $51,900

BASIS FOR RECOMMENDATION
The Advance Dilemma Zone Detection Phase II Project (No. TR-98-02) was advertised on Demandstar on July, 15, 2022. Eighteen (18) contractors requested bid documents. Sealed bids were opened on August 10, with five (5) responsive bids received. Bear Electrical Solutions, Inc. submitted the lowest responsive and responsible bid in the amount of $1,038,000 (Attachment 1 - Bid Summary).
ENVIRONMENTAL REVIEW
The project is exempt under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301(c), which applies to repairs, maintenance, or minor alterations of existing facilities (sidewalks, gutters, and similar facilities) involving negligible or no expansion of existing or former use.
Caltrans has also determined that under National Environmental Policy Act (NEPA), the project is classified as a categorical exclusion under 23 C.F.R. Section 771.117(c)(21), which covers “[d]eployment of electronics, photonics, communications, or information processing used singly or in combination, or as components of a fully integrated system, to improve the efficiency of safety of a surface transportation system or to enhance security or passenger convenience. Examples include, but are not limited to, traffic control and detector devices, lane management systems, electronic payment equipment, automatic vehicle locaters, automated passenger counters, computer-aided dispatching systems, radio communications systems, dynamic message signs, and security equipment including surveillance and detection cameras on roadways and in transit facilities and on buses.”
FISCAL IMPACT
Budgeted funds are available in Project 834250 - Advanced Dilemma Zone Detection Phase II. The project budget financial summary is included as Attachment 3 to this report.

Public contact was made by posting the Council agenda on the City's official-notice bulletin board outside City Hall, at the Sunnyvale Public Library, Senior Center, Community Center and in the Department of Public Safety Lobby.
