BACKGROUND

NOVA Workforce Services (NOVA) has received funding from federal and state governments through the Workforce Innovation and Opportunity Act, American Rescue Plan Act, and Personal Responsibility and Work Opportunity Reconciliation Act/California Work Opportunity and Responsibility to Kids. These funders require that workforce agencies or subrecipients have signatory authorization to participate in subgrants and agreements and accept funding.

 

At the July 18, 2000, Council meeting (RTC No. 00-259), the Council approved Resolution No. 167-00 to authorize acceptance of subgrants and agreements under the Workforce Investment Act and Personal Responsibility and Work Opportunity Reconciliation Act/California Work Opportunity and Responsibility to Kids. It also approved execution of documents pertaining to these subgrants and agreements. In addition, the resolution authorized the Mayor, City Manager, and NOVA director to conduct required negotiations and sign all documents and agreements. This is necessary for the acceptance, implementation, and management of subgrants and agreements.

 

Pursuant to federal law (29 U.S.C.A. Section 3122), the City Council is the “chief elected official”, and the “local grant recipient” and “fiscal agent” for NOVA and the Local Workforce Development Board. In filling these functions, City Council’s past practice for contracts exceeding $100,000 has been to approve the award of the contract and authorize the City Manager to execute the contract.

 

EXISTING POLICY

Council Policy 5.1.1: Socio-Economic - Goals and Policies: Education and Training

Goal 5.1F: Provide job training and employment services, within constraints of operative Federal regulations and available Federal funding, to address the locally-determined employment and training needs of economically disadvantaged residents and others with special needs.

 

ENVIRONMENTAL REVIEW

The action being considered does not constitute a “project” within the meaning of the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines section 15378(b)(5) in that it is a governmental, organizational, or administrative activity that will not result in direct or indirect changes in the environment.

 

DISCUSSION

Resolution No. 167-00 requires updates to reflect changes in funding from federal and state governments and the addition of an authorized signatory.

 

The former Workforce Investment Act was replaced with NOVA's current authorizing legislation, Workforce Innovation and Opportunity Act. The American Rescue Plan Act was added to reflect new diversification of funding. Funders in the resolution now include the Workforce Innovation and Opportunity Act, American Rescue Plan Act, and Personal Responsibility and Work Opportunity Reconciliation Act/California Work Opportunity and Responsibility to Kids.

 

In addition, the Assistant City Manager title has been added to the list of authorized signatories to conduct negotiations and sign documents and agreements. This change reflects City business operations and practices. As such, identified signatory positions in the resolution now include the Mayor, City Manager, Assistant City Manager, and Director of NOVA.

 

Additional changes were made to the previous resolution for format and clarity. The attached new resolution incorporates the changes identified above.

 

FISCAL IMPACT

The approved resolution will authorize the City to enter into agreements with federal and state governments, on behalf of NOVA Workforce Services, under the Workforce Innovation and Opportunity Act, American Rescue Plan Act, and Personal Responsibility and Work Opportunity Reconciliation Act/California Work Opportunity and Responsibility to Kids. It will also authorize acceptance of funding through these agreements.

Public contact was made by posting the Council agenda on the City's official-notice bulletin board outside City Hall, at the Sunnyvale Public Library, Senior Center, Community Center and in the Department of Public Safety Lobby. In addition, the agenda and report are available at the Sunnyvale Public Library, Office of the City Clerk, and on the City's website.

Recommendation

Adopt a Resolution authorizing acceptance of subgrants and agreements for federal and state funds on behalf of NOVA Workforce Services and execution of documents related to such subgrants and agreements.
