STAFF RECOMMENDATION

Recommendation

-                     Award a contract in substantially the same form as Attachment 2 to the report in the amount of $779,224 to J.J.R. Construction, Inc. of San Mateo;

-                     Make a finding of categorical exemption from the California Environmental Quality Act pursuant to CEQA Guidelines Section 15301 (c);

-                     Authorize the City Manager to execute the contract when all necessary conditions have been met; and

-                     Approve a 10% contingency in the amount of $77,922.

 

Pedestrian and Bike Infrastructure Improvements-VERBS (Project No. TR-18-07) was advertised on DemandStar on September 2, 2022. Forty-one (41) contractors requested bid documents. Sealed bids were opened on September 28, 2022, with five (5) responsive bids received. J.J.R. Construction, Inc. submitted the lowest responsive and responsible bid in the amount of $779,224.00 (Attachment 1 - Bid Summary). The list of locations for improvements is included as Attachment 4 to the report.

 

ENVIRONMENTAL REVIEW

The project is exempt under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301(c) as it involves repair, maintenance or minor alteration of existing highways and streets, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities involving negligible or no expansion of existing or former use.

 

Caltrans has also determined that under the National Environmental Policy Act (NEPA), the project qualifies as a categorical exclusion under 23 C.F.R. Section 771.117(c)(3) which covers "[c]onstruction of bicycle and pedestrian lanes, paths, and facilities”. NEPA review is required for construction projects receiving federal grant funding.

 

FISCAL IMPACT

Budgeted funds are available in Project: 833790 - Pedestrian and Bicyclist Infrastructure Improvements. The project budget financial summary is included as Attachment 3 to this report.

 

 

 

PUBLIC CONTACT

Public contact was made by posting the Council agenda on the City's official-notice bulletin board outside City Hall, at the Sunnyvale Public Library, Senior Center, Community Center and in the Department of Public Safety Lobby. In addition, the agenda and report are available at the Sunnyvale Public Library, Office of the City Clerk, and on the City's website.
