- Approve a 10% contingency in the amount of $242,227;  
- Authorize the City Manager to execute the contract when all  
necessary conditions have been met; and  
- Find the Project exempt from the California Environmental  
Quality Act (CEQA) pursuant to Guidelines Section 15262.

Wastewater Discharge Permit from East Bay Municipal Utility  
District (EBMUD) for the Disposal of Source-Separated  
Residential and Commercial Organic Waste from the  
Sunnyvale SMaRT Station® in the Amount of $470,000  
Recommendation:  
Authorize the City Manager to apply for a Discretionary  
Wastewater Discharge Permit in the amount of $470,000 with  
East Bay Municipal Utility District (EBMUD) for the disposal of  
source-separated residential and commercial organic waste  
from the Sunnyvale SMaRT Station(r) and authorize the City  
Manager to renew this permit for five additional one-year  
periods subject to available budget and as long as service and  
pricing remain acceptable.

Understanding Between the Santa Clara County Recycling  
and Waste Reduction Technical Advisory Committee (TAC)
